论振兴东北老工业基地的法治环境建设(1)[1]

摘 要:振兴东北老工业基地是一项系统工程,需全面调度,和谐并进。加强法治环境建设,既是老工业基地振兴的任务,也是老工业基地振兴的保障。如何评价老工业基地的法治状况?就东北某市的调查可以认为,在取得明显进步的同时,尚存在不容忽视的问题,如行政行为的随意化、利益化,行政监督的弱化;审判质量和效率不高,司法监督不力等。老工业基地振兴伴随着市场化进程的加快,法治的作用几乎无所不在,迫切需要法治环境的支撑。应加强地方立法,适时出台地方法规、规章;提高认识,努力建立行政执法、司法的良性机制;加强法治宣传教育。

　　Abstract:Revitalizing the old industrial base in Northeast China is a systemized project that needs comprehensive scheduling and coordination with a powerful laworder ruling environment provided to guarantee and protect its success How to assess the legal state of the old industrial bases in northeast China? According to the investigation made in a certain city in Northeast China, it was revealed that there are still some problems intolerable in respect to laworder ruling though the project is making remarkable headway, such as the arbitrary adminitration action/interests, weakened administrative supervision; low quality/efficiency of trial and inadequate judicial supervision A laworder ruling environment is therefore needed so urgently because of the near ubiquity of laworder ruling actions along with the rapid process of marketization which is an integral part of the revitalization To provide such an environment, the local legislation should be strengthened with appropriate local decrees, regulations and rules issued timelyMorever, it is necessary to require strictly all administrations to enforce the law and form a sound mechanism for judical affairs with all relevant officials/staff educated to abide by the law.

　　东北老工业基地的振兴,是一项需全面调度,和谐并进,各要素互相促进,经济政治文化共同发展的系统工程,如老工业基地改造中产业结构的调整,经济实体的转制,技术、资金、人才的引进,政策、制度、环境的保障,社会的稳定等。这些要素的综合状况如何,都将在一定程度上影响老工业基地改造的进展和成效,丧失或缺少其中的任何一个要素,都将产生不良的影响,制约或阻碍老工业基地改造的进程。其中,法治环境的保障是振兴中不可缺少的条件,老工业基地振兴需要与之相适应的法治环境。良好的法治环境既是老工业基地振兴的标志性成果,也是振兴过程中的基本保障。本文试图就法治环境对老工业基地振兴的影响、现实状况对法治环境的迫切要求、加强法治环境建设应着力解决的相关问题等进行一定程度的探讨。
