4.Force Majeure
Any delays in or failure of performance of either party,other than a delay
In our failure to make any payment required by this agreement,or a claim for for
Indemnification of a third party claim,shall not constitute a default hereunder or give rise to any claims for damage if,to the extent that,and for such period that,such delays or failures of performance are caused by the following specific orccurances provided such party gives to the other prompt notice of such cause,including but not limited to:act of God,or the public enemy,expropriation or confiscation of facilities,
Compliance with any duly promulgated order,injunction,law or regulation of any
Governmental authority,act of war,fires,floods,explosions,riots or strikes or any other cause beyond the reasonable control of the party.The party suffering such occurances agrees to use its best efforts to minimize the effect of any event operating to excuse its performance in cooperation with the other party.
