现行的外层空间法律法规虽然对外空军事控制作了一定的规定,也曾发挥过巨大的作用,但随着各国空间技术的发展,其暴露的缺陷也日益明显,难以从根本上改观愈演愈烈的外空军事化现象,因此,对现有的外层空间法规进行修订刻不容缓.
首先,针对现行国际空间法中使用的一些模棱两可的概念给空间法的具体应用带来的困难,我们应该对关于什么是“和平目的”和“外空武器”作出明确的界定.笔者认为和平目的是指非军事化利用外空,即禁止在外空从事一切军事活动,无论是进攻性的还是防御性的.外空武器不仅包括大规模杀伤性武器和核武器,并且在外空不得部署、使用、通过任何具有杀伤性的武器.
笔者认为,联合国大会应：
（1）加强对外空非武器化及防止外空军备竞赛国际法的促进和发展,通过国际政治性文件、提请国际法院发表咨询意见等方式进一步完善和丰富相关法律制度；充分发挥联合国国际法院对国际法发展的司法作用,通过国际法院的司法机制不断完善和发展现行的国际空间立法.
（2）通过联合国大会的政治影响力促进“防止外空军备竞赛”议题在日内瓦裁军会议中讨论的深入.
（3）加强联合国安理会对外空非武器化及防止外空军备竞赛的监督与核查机制.外空武器化及外空军备竞赛是一种对国际和平与安全的新威胁,应将防止外空武器化及外空军备竞赛纳入联合国集体安全机制.加强联合国安理会对国际社会发展、部署、使用空间武器的监督与核查机制的建设,从根本上防止外空武器化及外空军备竞赛.

Despite the current outer space law and legislation that has some control over the external space, it is not effective enough. As the development of space technology of each country, the defect regularly becomes sharp and serious, hardly managing to solve the overwhelmingly militarization of outer space. It is thus urgent to revise the current legislation to outer space.
At the first place, as to the difficulty in application brought by ambiguous concepts appearing in the legislation of outer space, we should give a exact and precise definition to "peace purpose" and "outer space weapon". In my opinion, peace purpose is to take use of the outer space in non-military area, that is, to forbid all the military activities in the outer space whether they are agressive or defensive. While outer space weapon not only consists of weapons causing mass destruction and nuclear weapons, but also does not approve of the arrangement and usage via all the weapons that might any damage.
As far as I am concerned, the UN convention should
(1)strengthen the non-militarization of outer space and prevent the improvement and promotion of the international law of the competition of outer space military equipment. Moreover, through international political documents, put forth proposal on advisory to the International Court of Justice to call on to improve the law system; take full use of the fuction of United Nations International Court of Justice upon the international judicial system and through the International Court of Justice give a continuous improvement and development of the current international space legislation.
(2)under the political influence of UN convention, promote the futher discussion on the issue" fobidding the competition of outer space equipment" in the Geneva Conference.
(3)Strengthen the United Nations Security Council non-weaponization of outer space and monitor of preventing the competitionin outer space. Weaponization of outer space and the competition of outer space is a kind of new threat to the international peace and security; it should be held back that the weaponization of outer space and the competition of outer space equipment define to the United Nations collective security mechanism; strengthen the United Nations Security Council for international social development, arrangement, monitoring the use of space weapons and the construction of the crosschecking mechanism, primarily preventing the outer space weaponization and the comepetition of outer space equipment.
