论文主要分为四大部分.第一部分主要介绍的是组织残疾人、儿童乞讨罪的立法背景和概念.第二部分主要谈论的是此罪的犯罪构成.接下来讲此罪的认定以及在实践运用中应该注意的问题.最后一部分主要是笔者对此罪的一些意见和建议.笔者认为,此罪在以下三个方面还存在一些不足之处,应予以完善.首先,此罪的犯罪对象的范围有点狭窄,应该扩大此罪的犯罪对象；其次,本罪的入罪门槛偏低,有待于提高；最后一点是此罪与其他一些罪名的法定刑不协调,影响法律的公正性,应该予以协调.笔者希望通过以上分析,对此罪进行一番较为系统和全面地探讨,以其有助于司法实践.
